We at Inktera™ (“us,” “our” “we,” or “Company”) consider the protection of your personal information to be a priority when you visit our website or use our software applications, services and/or devices (“Solutions”). The guidelines contained in this privacy statement apply to only information collected, used and/or disclosed by us via the Internet and describe how we may collect, use and disclose information that we receive.

We reserve the right to modify this Privacy Statement at any time without notice (for example, if we modify our practices regarding the collection or use of information). We will revise our Last Updated date to reflect any revisions to this Statement. Your continued use of the Solutions following the posting of any revisions shall constitute your acceptance thereof.

What Information Do We Collect?

  • We do not collect any personally identifiable information (“PII” or “personal information”) about you unless you voluntarily submit the information to us such as when you place an order, submit a product review, register to use the Solutions, enter a contest or sweepstakes, respond to a survey, register for a newsletter or communicate with us by email.
  • The types of PII we may request include your name, mailing address, email address, telephone number and credit card information.
  • When you purchase a product to be delivered as a gift, we also collect personal information about the gift recipient so that we can fulfill your gift purchase. Any gift recipient’s personal information is not used for marketing purposes.
  • We may capture certain information automatically on our Solutions (even if you do not voluntarily provide us with personal information, or in addition to any personal information that you do provide), including your Internet Protocol address, mobile device identification number, browser type, page access history, linking information, click stream data, page visits, page views, web site log files. Our systems may make navigational information identifiable to you, and, if so, it will be treated (in any such format that makes it identifiable to you) as personal information for the purposes identified in this policy.
  • We may use cookies or similar devices to keep track of and enhance certain activities available on the Solutions such as by helping us to remember and process the items in your shopping cart. Unless you affirmatively elect a particular user functionality that employs persistent cookies, our cookies are session based and do not store information beyond the particular session in which the browser is opened and the Solutions are accessed.

How Do We Use Your Information?

We may use the information we collect from you in the following ways:

  • To personalize and enhance your Solutions experience and to allow us to deliver the type of content and product offerings which may be of interest to you.
  • To quickly process your purchases.
  • To allow us to respond efficiently to your service requests.
  • To administer a contest, promotion, survey, product review or other feature.
  • If you have “opted-in” to receive email and/or SMS communications from us, to send you our newsletter, coupons or any other promotional material. If you would no longer like to receive promotional email or SMS communications from us, please refer to the “How Can You Manage Your EMail and Mobile Marketing Preferences” section below.
  • To allow us to disclose your information to the extent permitted by law, as described more fully below.

How Do We Protect Personal Information?

Although we cannot guarantee the impenetrability of our servers, we have established and implemented reasonable physical, electronic, and administrative procedures to safeguard and secure the personal information we collect online.

Our Solutions may contain customer reviews, forums and/or message boards. You have control over what information about yourself you choose to share on our Solutions. Please be aware that when you post content on our Solutions, such content may be viewed by other users and by the general public, including any such content that contains personal information. All such sharing of information and content is done at your own risk.

Do We Disclose the Information We Collect to Outside Parties?

We do not sell, trade, or otherwise transfer to third parties your personally identifiable information unless we provide you with advance notice as described below:

  • Content providers. We work closely with the entities that provide the content (journals, books, magazines, etc.) that we make available to you through the Solutions. Many of our contracts with these entities require that we forward the personal information that we collect about you, to them.
  • Subsidiaries and Affiliates. We may transfer personally identifiable information to our subsidiaries and corporate affiliates.
  • Solutions Consultants and Service Providers. We may disclose personal information to third party consultants and service providers (such as providers of hosting, support, maintenance; third party credit card processing agencies; and remedial and repair services) to the extent that they require access to our databases, or the information contained in our databases, to service Company and the Solutions.
  • Enforcement of Rights/Security. We reserve the right to release personal information (i) when we are under legal compulsion to do so (e.g. we have received a subpoena) or we otherwise believe that the law requires us to do so, (ii) when we believe it is necessary to protect and/or enforce the rights, property interests, or safety of the Company, our users or others, or (iii) as we deem necessary to resolve disputes, troubleshoot problems, prevent fraud and otherwise enforce the Privacy Statement and other Solutions user agreements.
  • Reorganization or Sale of the Company. In the event that the Company is merged with or becomes part of another organization, or in the event that Company is sold or it sells all or substantially all of its assets or is otherwise reorganized, the information you provide will be one of the transferred assets to the acquiring or reorganized entity.
  • As Otherwise Allowed by Law. We may transfer personal information to third parties where we are expressly authorized by applicable law to do so.
  • Aggregated Information. We may aggregate information that you provide with information provided by other individuals in such a manner that the information is not personally identifiable to you, and we may transfer that aggregated information to third parties.

If you registered for an account, you may log into your account at any time and modify, delete or update your information. Additionally, you can unsubscribe from promotional emails or text messages by following the instructions contained within the communication. Please note that due to marketing production schedules you may receive any messages already in production.

What About Privacy on Third Party Linked Sites?

In an attempt to provide you with increased value, the Solutions may contain links to third party sites. These linked websites have separate and independent privacy policies or may have no privacy policy at all. We are not responsible or liable for the content, activities or privacy policies of such linked sites. Nonetheless we seek to protect the integrity of the Solutions, and welcome any feedback about a linked site (including if a specific link does not work).

Notice Regarding Children’s Use

We believe that children using the Internet require special protection and care, and we urge parents/guardians to explain Internet safety to their children. Parents are urged to spend some time with our Solutions to become familiar with the type of content available.

However, you may not sign up for our Solutions and/or purchase content if you are less than 13 years of age. Likewise, if you are under 13 years of age, you should not provide any personal information (for example, your last name, home address or email address) on our Solutions. If we discover that you are under 13 years of age and registered on our systems, we will remove any personal information about you on our systems.

Notice to California Residents – Your California Privacy Rights:

If you are a California resident, you have the right to receive the following information:

  • information identifying any third party company(ies) to whom we may have disclosed, within the past year, personal information pertaining to you and your family for that company’s direct marketing purposes; and
  • a description of the categories of personal information disclosed.
